Platform Terms of Service

Effective Date: April 13, 2026

These User Terms (“User Terms”) govern your access to and use of the NSS platform and related services when a club, academy, or other organization that has contracted with NSS (the “Customer”) grants you access as an authorized user.

If you are using the Services through a Customer, these User Terms are between you and NSS, but the Customer controls your access and much of the data associated with your use of the Services.

1. Relationship Between NSS, Customer, and You

  1. The Customer, not you, has the primary contractual relationship with NSS for the Services.
  2. The Customer may authorize, restrict, or terminate your access to the Services.
  3. Data you submit to the Services through the Customer’s account is generally controlled by the Customer, subject to the Customer’s agreement with NSS.
  4. The Customer is responsible for obtaining any permissions or consents needed for your use of the Services and for the lawful submission and handling of related data.

2. Eligibility and Minors

2.1 Authorized Users Only

You may use the Services only if a Customer has authorized you to do so.

2.2 Children Under 13

Children under 13 may not register for, hold, or independently control NSS account credentials.

If a Customer allows a child under 13 to view information through the Services, that access must occur only through a parent or guardian-controlled Family Account or under the direct supervision of a parent or legal guardian.

By using the Services, you represent that you are not independently using the Services as a child under 13.

2.3 Minors Ages 13–17

If you are 13 to 17 years old, you may use the Services only if the applicable Customer permits such use and, where required, with the knowledge, supervision, and consent of a parent or legal guardian.

If you are a parent or guardian providing information or supervising access for a minor, you represent that you have the authority to do so.

3. Account Security

You are responsible for maintaining the confidentiality of your login credentials and for activities occurring under your account. You must notify the Customer and NSS promptly if you suspect unauthorized access.

You may not share credentials except as expressly permitted for an adult-controlled Family Account.

4. Acceptable Use

You may not:

  1. use the Services for any unlawful, harmful, fraudulent, or deceptive purpose;
  2. attempt unauthorized access to any account, system, or data;
  3. scrape, reverse engineer, copy, or exploit the Services beyond authorized use;
  4. upload malicious code or harmful content;
  5. interfere with the Services or other users;
  6. use the Services to harass, abuse, threaten, or violate the rights of others; or
  7. submit data you do not have authority to submit.

5. Customer-Controlled Data

You acknowledge that:

  1. the Customer owns or controls the Customer Data associated with the Customer’s account;
  2. the Customer may access, disclose, correct, export, or delete Customer Data, including information associated with your account; and
  3. NSS may rely on instructions from the Customer regarding that data.

6. Confidentiality

You may have access to non-public information about the Customer, NSS, athletes, coaches, staff, or other users. You agree to use such information only as necessary for authorized use of the Services and not to disclose it without proper authority.

7. Feedback

If you send NSS feedback or suggestions regarding the Services, you grant NSS a perpetual, worldwide, irrevocable, royalty-free license to use and exploit that feedback without obligation to you.

NSS or the Customer may suspend or terminate your access if:

THE SERVICES, REPORTS, OUTPUTS, AND ALL RELATED CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, NSS DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, OR THAT THE SERVICES WILL ALWAYS BE AVAILABLE OR ERROR-FREE.

NSS does not guarantee any athlete, coaching, organizational, or performance outcome.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NSS SHALL NOT BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO THE SERVICES OR THESE USER TERMS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NSS’S TOTAL AGGREGATE LIABILITY TO YOU ARISING OUT OF OR RELATING TO THE SERVICES OR THESE USER TERMS SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100).

11. Governing Law and Venue

These User Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Any dispute arising out of or relating to these User Terms shall be brought exclusively in the state or federal courts located in or serving the county where NSS maintains its principal California operations, unless NSS designates another California venue in writing.

12. Changes to These User Terms

NSS may update these User Terms from time to time. If you continue using the Services after updated User Terms become effective, you agree to the updated version.
